Filing a medical malpractice lawsuit against your doctor is fairly common actually. Winning a medical malpractice lawsuit is another story all together. Let's go over some medical malpractice laws, costs, and legal issues.
Medical Malpractice Laws
The laws that would apply in your medical malpractice claim or lawsuit varies from state to state. Since this area of law does fall under state law, your state will provide the applicable legal regime for the suit. I can tell you that they all fall under some sort of negligence claim, where you must prove that the doctor acted in a negligent manner, but the particulars from state to state are very detailed. For instance, in Louisiana you must first file for a review by a medical review board before proceeding to ciurt with your medical malpractice claim. In some states you don't have to. The important thing is to find out which laws apply to you, and then read them and the developing case law for further instructions.

Medical Malpractice Costs
Virtually every medical malpractice lawyer or attorney works on a contingency basis. If your doctor negligence case has some merit to it, you should be able to find a malpractice attorney that will take it. The contingency fees vary, but expect to pay around 1/3 of the amount of damages awarded, plys court costs. Remember that these malpractice fees are negotiable, so never hesitate to strike a better bargain for yourself.

Medical Malpractice Issues
There are several issues or hurdles in medical negligence cases that almost always come into play. One of the biggest ones is that doctors usually stick together. Trying to find a doctor to act as an expert witness against your doctor at trial is difficult, at best. Another issue is that doctors usually act within the reasonable standard of care. Just because your injury got worse, or the surgery didn't work, that doesn't mean that your doctor was necessarily negligent in the work performed.
